Red Systems LLC, dba Delegated (“Delegated”), respects the privacy of its clients and other users of its website located at www.delegated.com, including any subdomains of such website (the “Site”), and any mobile applications or other digital media offered by Delegated (together with the Site, our “Digital Properties”). This Privacy Policy explains how Delegated collects the personal information of the users of the Digital Properties (collectively, “Users”), how Delegated handles and protects that information, and what Users can do to help protect that information.
Delegated reserves the right, at our discretion, to change, modify, add or remove portions of this Privacy Policy at any time by posting the amended Privacy Policy on the Site. If you are a client of Delegated at that time, you may also be given additional notice, such as an email message or messaging, of any changes. You should review this policy periodically, and especially before you provide any Personal Information. No amendment to this Privacy Policy shall apply to any dispute of which Delegated had actual notice before the date of the amendment. Your continued use of any Digital Properties after we post any modifications to the Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. Except as otherwise stated, all amended terms shall automatically be effective thirty (30) calendar days after they are initially posted.

Collection of Information
When you engage in certain activities on the Digital Properties, such as registering an account, inquiring about our services, obtaining such services, contacting customer service, or sending us feedback, we may ask you to provide certain information about yourself, which may include personally identifiable information such as your name, e-mail address, address, and mobile phone number (collectively “Personal Information”). If you are a client, we may also collect certain other information necessary to fulfill the service that you have requested, including, for example, loyalty program cards numbers, addresses to deliver items you ask us to order on your behalf, and your passport number and other travel document information. By voluntarily providing us with your Personal Information and other information, you are consenting to our use of it in accordance with this Privacy Policy. We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, all such financial information, together with any Personal Information that you provide in the order process, is provided directly to our third party processor, Chargify. The third party processor’s use of your financial information and any other Personal Information that you provide to them in the order process, is governed by the third party’s privacy policy which may be viewed at https://www.chargify.com/privacy-policy. If you request, as part of the services that Delegated provides, that we make purchases for you with your credit card, we will collect and use your credit card information solely for such purpose.
In addition, some or all of the Digital Properties automatically collect anonymous information about Users. For example, the Site automatically gathers a User’s Internet Protocol address, which Internet Service Provider the User utilizes, statistics about how Users navigate through and use the Site, and information gathered through the use of “cookies.” A “cookie” is a piece of data stored on the User’s computer tied to information about the User. Delegated uses cookies and the other anonymous information to understand how Users choose the Digital Properties, and to know when Users have accessed the Digital Properties from a paid advertiser, an affiliate website, or a strategic partner website. Delegated also compiles statistics that track the usage of the Digital Properties. These statistics are used for internal purposes only and contain no Personal Information.
Solely for the purposes of confirming valid traffic from certain pay-per-click search engines, IP addresses for Users may be monitored, and may be compared to the records of that search engine.
How Delegated Responds to Do Not Track Signals
At this time the Site does not recognize automated browser signals regarding tracking mechanisms, which may include “do not track” instructions. However, you can change your privacy preferences regarding the use of cookies and similar technologies through your browser. How Delegated Protects and Uses Personal Information
Delegated works to protect the security of Personal Information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information that is transmitted on the Site and other Digital Properties. Delegated uses the Personal Information of a User to market its services, carry out its service for clients, and to respond to customer service or support questions. Delegated may employ companies and individuals to perform functions on Delegated’s behalf. Examples may include providing marketing assistance, performing statistical analysis, providing customer service and processing orders and payments. These companies and individuals will have access to the Personal Information only as necessary to perform their functions, and may not access or use it for any other purpose. If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by Delegated to third parties for the third parties’ direct marketing purposes. Delegated has appropriate security measures in place within its database and physical facilities to protect against the loss, misuse, or alteration of information that has been collected on the Digital Properties. These measures include limiting the number of people who have physical access to Delegated’s database servers, as well as electronic security systems and password protections which guard against unauthorized access. However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.
Delegated may occasionally use a User’s Personal Information to provide customer service to the User, such as communicating with Users about their accounts and/or requests for services.
Delegated may also use a User’s Personal Information to notify the User of Delegated’s products and special offers via periodic mailings or e-mail updates. Users may opt-out of these communications by emailing Delegated at info@delegated.com with “UNSUBSCRIBE” in the subject line.
Delegated will not sell Personal Information of any User. However, in the event Delegated goes through a business transition, such as a merger or an acquisition of its equity interests or assets, the Personal Information of Delegated’s Users will, in most instances, be part of the assets transferred.
In addition to use of your Personal information described elsewhere in this Privacy Policy, we may share Personal Information with companies, organizations or individuals outside of Delegated if we have your express consent to do so.
Access to Client Inbox And Calendar
In the event you authorize us to access your email or calendar accounts, we will not share their contents with third parties without your consent except as necessary to perform the services requested and as required for Legal Compliance as described below. We reserve the right to turn over any information related to any potentially illegal activity contained in these accounts to law enforcement for civil and/or criminal penalties. It is solely your responsibility to notify any senders of email or meeting invitations or responses that you have delegated your email and calendar to us and that their emails may be observed by us on your behalf.
Third Party Websites
Delegated may maintain links to other websites on the Digital Properties, including social media sites. If a User chooses to visit other websites from any Digital Properties, Delegated will not be responsible for the privacy practices or content of those other websites.
Testimonials
Delegated may post client testimonials on the Digital Properties. Delegated will obtain the prior consent of the client prior to posting any testimonial that contains that client’s name or other Personal Information.
Children’s Online Privacy
The Children’s Online Privacy Protection Act of 1998 (“COPPA”) imposes restrictions on commercial websites, including ours. It is our policy to be compliant with the requirements of COPPA and not to solicit or collect personally identifiable information from children under age 13 (“Child”) without parent or guardian consent. If you are a parent or guardian and you learn that your Child has provided us with Personal Information, please contact us. If we discover that a Child under 13 has provided us with Personal Information, we will delete such information from our servers.
Legal Compliance
Although Delegated makes every effort to preserve User privacy, Delegated may need to disclose or provide access to Personal Information if Delegated has a good faith belief that such action is necessary to (a) comply with the law, such as in connection with a judicial proceeding, court order or legal process, (b) enforce our Terms of Use, including investigation of potential violations, (c) detect, prevent, or otherwise address fraud, illegal activity, network security or technical issues concerning our service, (d) protect against harm to the rights, property or safety of our company, our users, our clients or the public as required or permitted by law, or (e) detect, prevent, or otherwise address risks to national security or other important public interests.
Consent to Data Processing In United States
Our Digital Properties are operated and managed on servers located and operated within the United States. By using and accessing our Digital Properties, residents and citizens of countries and jurisdictions outside of the United States agree and consent to the transfer to and processing of Personal Information on servers located in the United States, and that the protection of such information may be different than required under the laws of your residence or location.
